As used in this chapter, “legislative body” means the board of supervisors in the case of a county or a city and county, the city council or board of trustees in the case of a city, and the board of directors or other governing body in the case of a district or other public agenc…

As used in this chapter, “local agency” means municipal corporation or sanitary district. (Added by Stats. 1949, Ch. 81.)

As used in this chapter, “conduits” mean sewers, watermains, and other conduits. (Added by Stats. 1949, Ch. 81.)

Under the terms prescribed by its legislative body, a local agency may permit another local agency to construct and maintain conduits in, across, or along its streets and other public places pursuant to this chapter and not otherwise. (Added by Stats. 1949, Ch. 81.)

When it is necesary to acquire property in the construction of any outfall sewer or conduit pursuant to this chapter, the property may be acquired by eminent domain. (Amended by Stats. 1975, Ch. 1240.)

All condemnation actions may be brought by and in the name of one local agency designated by all of the parties to the agreement. (Added by Stats. 1949, Ch. 81.)

When this chapter or the principal act requires publication of a notice, publication shall be in a newspaper of general circulation published and circulated within the district, or if there is none, in the newspaper of general circulation published nearest to the district. (Added…

Unless otherwise expressly provided, each notice shall be published once a week for three successive weeks prior to the date set for the event of which notice is given. (Added by Stats. 1951, Ch. 331.)

Proof of publication may be by affidavit of the owner, publisher, printer, or clerk of the newspaper. The affidavit is prima facie evidence of the facts stated in it. (Added by Stats. 1951, Ch. 331.)

If a district is situated in a county in which no newspaper of general circulation is published, the notice shall be posted in three public places in the district for the same period as if published. (Added by Stats. 1951, Ch. 331.)
