The provisions of this article 49 shall not apply to any hospital or other facility that the department of public health and environment is authorized to license pursuant to part 1 of article 1.5 and part 1 of article 3 of title 25; except that nursing care facilities, assisted living residences, and home health agencies that are part of the facility of a provider as defined in section 11-49-101 are subject to the provisions of this article 49.
