Certified, Technical and Professional Positions. (a) The Board shall adopt rules and regulations governing selection, compensation, promotion, performance evaluation, disciplinary action and other terms and conditions of employment of personnel occupying maritime positions unique to Port operations and certified, technical and professional positions, subject to the provisions of the Administrative Adjudication Act. (b) Such rules and regulations shall provide for the employment and retention of persons on the basis of merit and shall include an orderly and systematic method of recruitment and the establishment of a list of qualified applicants. (c) Maritime positions unique to Port operations and certified, technical and professional positions are defined as:

(1) positions whose qualification requirements mandates certifications and licensing requirements, e.g., stevedores, cargo checkers, equipment operators, marine traffic controllers, etc.; (2) positions with multi-skill qualification requirements, e.g., preventive maintenance mechanics, crane mechanics, etc.; (3) positions with specific maritime knowledge and skills, e.g., tariff technicians, etc.; and (4) other similar technical and professional positions which are unique and critical to the Port’s operations and no other government entity which is not a port of entry, but not limited to those jobs listed herein.
