2 GCA § 1120

(a) The employees and attaches of the Legislative Branch are entitled to the same retirement benefits, subject to the same contributions and conditions as employees of the Executive Branch of the government of Guam as provided by 4 GCA Chapter 8. (b) Elected officials who have retired from the government of Guam and who are receiving retirement benefits from the Government or elected officials who are eligible to receive retirement benefits from the Government shall not relinquish, forfeit, or have such benefits suspended during the periods such elected officials are holding their respective offices; provided, however, that such elected officials shall not be deemed active members of the retirement fund for purposes of such elected office service, and no deductions shall be made nor government contributions made on account of any salary they receive as such elected officials.
