5 GCA § 20602

Unless the context otherwise requires, the definitions set forth in this Section govern the construction of this Article. (a) Records means document, book, paper, photograph, sound recording, or other material, regardless of physical form or characteristic, made or received pursuant to law or in connection with the transaction of official business. Library and museum material made or acquired and preserved solely for reference or exhibition purposes, extra copies of documents preserved only for convenience or reference, forms and stocks of publications are not included within the definition of records and are referred to herein as non-record materials. (b) Agency means: (1) any department, office, commission, board or other government of Guam. (2) the office of the Recording Secretary of the Guam Legislature. SOURCE: GC § 6701. Subsection (b) amended by P.L. 22-093:1 (Mar. 7, 1994). 2024 NOTE: As proposed by Bill 255 (LS), subsection (b)(1) stated: “Agency means any department, office, commission, board or other unit, however designated, of the Executive Branch of the government of Guam.” However, when enacted as P.L. 22-093, subsection (b)(1) did not include the words “unit, however designated, of the Executive Branch of the.” In past publications of the GCA, the Compiler had inserted the bracketed word “unit” in subsection (b)(1), and included the following Comment: COMMENT: The purpose of this repeal/reenactment was to include the Recording Secretary within the purview of the Records Management law. The former subsection (b) included the word unit in describing the Executive Branch of the government. The amendment omitted any such reference, making it unclear just what other was intended. The current publication reflects the language of subsection (b)(1) as it was amended by P.L. 22-093. To include other language not enacted by P.L. 22-093 would exceed the authority of the Compiler to correct “manifest clerical errors or typographical errors.” See 1 GCA § 1606. 2013 NOTE: Numbers and/or letters were altered to adhere to the Compiler’s alpha-numeric scheme in accordance to 1 GCA § 1606.
