Jurisdiction of Summary Courts-Martial

(a) Subject to § 63716.1 of this Code, summary courts-martial have the jurisdiction to try persons subject to this Code, except officers, for any offense made punishable by this Code. (b) No person with respect to whom summary courts-martial have jurisdiction may be brought to trial before a summary court-martial if he objects thereto. If objection to trial by summary court-martial is made by an accused, trial may be ordered by special or general court-martial, as may be appropriate. (c) A summary court-martial may sentence to a fine of not more than Twenty-Five Dollars ($25) or confinement of not more than twenty-five (25) days for each single offense, grant forfeiture of pay and allowances, and order a reduction to the ranks, including a noncommissioned officer. However, in no case may the total fine of Fifty Dollars ($50) and confinement of fifty (50) days or a combined total of One Hundred Dollars ($100) and one hundred (100) days be exceeded.
