Schedule I Tests

(a) DPHSS shall add, in accordance with § 67.201(a), a substance to Schedule I upon finding that the substance: (1) has a high potential for abuse; (2) has no currently accepted medical use in treatment in the United States; and (3) lacks accepted safety use under medical supervision. (b) DPHSS may add a substance to Schedule I without making the findings required by Subsection (a) if the substance is controlled under Schedule I of the Federal Controlled Substances Act by a Federal agency as the result of an international, treaty, convention or protocol. NOTE: Pursuant to the authority granted by 1 GCA § 1606, numbers and/or letters were added to this section.
