Transshipment and In-Transit Shipment Penalties

Any person who is guilty of an offense pursuant to § 67.603 of this Act shall be subject to the following penalties: (a) Except as provided in § 67.401.10 (b), any such person shall, with respect to any such offense, be fined not more than Twenty-five Thousand Dollars ($25,000.00). (b) If such an offense is prosecuted by an information or indictment which alleges and the trier of fact specifically finds that the offense was committed knowingly or intentionally, the defendant shall be sentenced to imprisonment for not more than one (1) year or a fine of not more than Twenty-five Thousand Dollars ($25,000.00), or both.
