Continuing Duty to Disclose

If, prior to or during trial, a party or his attorney discovers additional material or information previously requested or ordered, which is subject to disclosure under this Chapter, he shall promptly notify the other party or his attorney or the court of the existence of the additional material or information. NOTE: Section 70.40 is substantively the same as a portion of former Rule 16(g).
