(a) Any owner, and any person acting on behalf of an owner, who shall submit an application for registration or renewal of registration of a vehicle, knowing that the gross weight of such vehicle is understated in such application, shall be guilty of a misdemeanor. (b) Where the Director of Revenue and Taxation, or her/his authorized representative, has accepted the statement as to gross weight of a vehicle made by an owner, or by any person acting on behalf of an owner, in an application for registration or renewal of registration, pursuant to § 7164, evidence that a subsequent weighing of the vehicle indicates a gross weight of the vehicle in excess of that set forth in the application shall constitute a prima facie case sufficient to warrant a conviction under Paragraph (a) of this Section.
