Where a witness disobeys a subpoena, and disobedience thereof is not covered in the Guam Rules of Civil Procedure, he forfeits, in addition to any other penalty for contempt of court, to the party aggrieved the sum of Fifty Dollars ($50) and all damages which he may have caused by his failure to attend, which forfeiture and damages may be recovered in a civil action. This Section is clarified to separate it from the Rules of Civil Procedure and to show that the forfeiture is not a penalty payable to the Court, but to the party aggrieved.
