Released. (a) The qualified mental health professional staff providing ninety (90) days involuntary treatment shall not be held civilly or criminally liable for any action by a person released at or before the end of the ninety (90) day period. (b) If during the ninety (90) days of involuntary treatment the patient has threatened the life or safety of any other person, it shall be the duty of the qualified mental health professional staff to make a good faith effort to com- municate the substance of such threats to the person so threatened prior to the release of the patient, and no person who has made such threats may be released until after a court hearing approving such release.
