Criminal Penalties

(a) Any person who intentionally or knowingly violates this Act is guilty of a third degree felony. (b) Any physician who intentionally or knowingly performs a partial- birth abortion and thereby kills a human fetus shall be fined not less than Ten Thousand Dollars ($10,000.00) nor more than One-Hundred Thousand Dollars ($100,000.00) under this Title, or imprisoned for not less than one (1) year nor more than ten (10) years, or both.
