Petty Misdemeanor: Punishment. It is unlawful for any person, whether a driver or passenger, to consume marijuana in any manner including, but not limited to, smoking or ingesting in a motor vehicle when the vehicle is upon a public highway. Any person convicted of violating this
Section shall be guilty of a petty misdemeanor. 2019 NOTE: Notwithstanding the declassification of marijuana as a Schedule I controlled substance, P.L. 35-005:2 (Apr. 4, 2019) enacted 11 GCA § 8112(d), which expressly provides: “Nothing in this Chapter is intended to allow driving under the influence of cannabis or to supersede laws related to driving under the influence of cannabis.”
