Damages

In any action or proceeding for violation of the requirements of this Article, the Health Plan Administrator or the Health Care Provider shall be entitled to recover all costs of litigation or arbitration, including reasonable attorneys’ fees or arbitration costs, incurred in the successful prosecution of the action or proceeding.
