RELATING TO COMMERCIAL DRIVER'S LICENSES.

Lowers the age of who may drive commercially within the State from nineteen to eighteen. Repeals the requirement that a person only operates category 3 vehicles to qualify to drive commercially in the State. Prohibits a person under twenty-one years of age from operating a commercial motor vehicle outside of state-approved commercial driver training programs or registered apprenticeship programs as determined by the Department of Labor and Industrial Relations. Requires the Department of Transportation to consult with DLIR to amend its rules to allow persons under twenty-one years of age to operate a commercial motor vehicle under certain conditions. (SD1)

Requires persons currently serving in positions made subject to the advice and consent of the Senate by this Act to obtain the advice and consent of the Senate during the Regular Session of 2027 unless the appointee was subject to the advice and consent of the Senate. By July 1, 2027, requires the Department of the Attorney General to develop a Human Trafficking Awareness Training Program to educate and train workers in the transient accommodations sector. Requires transient accommodations employers and transient accommodations third-party contractors to periodically provide the human trafficking awareness training to certain employees and contract workers and keep records of the training. By January 1, 2028, requires transient accommodations employers and transient accommodations third-party contractors to post signage regarding human trafficking awareness. By October 1, 2027, requires transient accommodations employers and transient accommodations third-party contractors to develop and implement a human trafficking prevention policy that includes procedures for the reporting of suspected human trafficking.

Authorizes the Department of Business, Economic Development, and Tourism to declare up to two census tracts in the State that contain an innovation enterprise to be designated as an enterprise zone, subject to the Governor's approval. Requires DBEDT to conduct an in-house comprehensive review, in consultation with the Department of Taxation, of the State Enterprise Zones Program and requires a report to the Legislature. Establishes a new gift card fraud law, under the scope of unfair and deceptive practices law, which requires merchants and third-party gift card resellers to take certain steps to prevent gift card scams. Requires the Office of Consumer Protection to create model notices and issue certain guidelines. Requires the conspicuous provision of information regarding terms and conditions of gift certificates, regardless of whether the cards are sold in person, electronically, or telephonically. Extends the minimum redemption period for paper gift certificates from two to four years. Establishes penalties. Effective 7/1/2050. (SD2)

RELATING TO THE HAWAIIAN FLAG.

Requires cooperative housing corporations, planned community associations, and condominium associations to allow owners to display the Hawaiian flag within the owner's property. Allows reasonable time, place, manner, and size restrictions on Hawaiian flag displays to protect a documented substantial interest of the association or corporation. Authorizes cooperative housing corporations, planned community associations, and condominium associations to impose stricter size restrictions on Hawaiian flag displays or eliminate the flagpole or have its height lowered if the documented substantial interest is related to health or safety. Imposes the manufacturing general excise tax rate on motion picture, digital media, and film productions and repeals the provision in the definition of "qualified production costs" that applied the term to mean costs incurred that are subject to the highest general excise tax rate. Exempts from the general excise tax amounts received by a motion picture project employer from a client company equal to amounts that are disbursed by the motion picture project employer for employee wages, salaries, payroll taxes, insurance premiums, and employment benefits and payments to loan-out companies. Requires the Bureau of Conveyances to notify an affected party when any recorded instrument was purportedly fraudulently notarized, when attested to by the purported notary public. Requires the Bureau of Conveyances to allow an affected party to void the recorded instrument that was purportedly fraudulently notarized. Requires the Bureau of Conveyances to allow title holders to suspend additional recordings on their title, unless given prior authorization by the title holder, subject to certain limitations. Clarifies that the State is not responsible for any economic loss or damages related to any actions by the Department under chapter 150A, Hawaii Revised Statutes. Authorizes the Department to compel the quarantine of certain non-agricultural items or materials. Allows for certain interim rules adopted by the Department to be effective for up to two years. Appropriates funds to establish one full-time equivalent position within the Department to assist the Plant Industry Division Administrator in drafting, reviewing, and updating certain administrative rules. Requires a digital application store provider to verify the age of users, require parental consent for users under sixteen years of age to download or purchase, or make a purchase on, a social media platform, and distribute that information to social media platforms. Requires social media platforms to obtain the age information from digital application store providers, determine whether parental consent has been provided for young persons, and take reasonable steps to identify young person users through their algorithms. RELATING TO WORKERS' COMPENSATION.

Defines compounded prescription drugs for the purposes of the State's Workers' Compensation Law. Limits dispensing of prescription drugs by physician to 30 days after the industrial injury and requires all prescription drugs to be obtained through the employer's pharmacy benefit manager thereafter. Requires prescription drugs not approved by the Food and Drug Administration (FDA), such as compounds, to be identified as compounds when listed on the treatment plan and when billed, and be supported by a statement of medical necessity documenting the case of medical need for a compound drug over an FDA-approved over-the-counter or prescription drug of similar therapeutic effect. Defines a "dog breeder" as any person who owns, possesses, controls, or otherwise has charge or custody of more than ten dogs over the age of twelve months with intact sexual organs, and who sells, barters, or otherwise transfers more than three litters and more than twenty-five dogs per calendar year. Requires dog breeders to meet minimum standards of care and not place certain types of dogs in the same enclosure to ensure the proper treatment and care of dogs and the dogs' offspring. Prohibits any person from owning or having custody of more than thirty dogs over one year with intact sexual organs. Requires dog breeders to maintain specific written records for each dog for a specified period. Authorizes each county to assess, implement, and enforce its own licensing system for dog breeders.
