Establishes fees that medical providers may charge for requests for a patient's medical records from the patient's family member, caregiver, or representative. Requires medical providers to respond to requests in a timely manner. Establishes penalties.

RELATING TO THE HAWAII ABLE SAVINGS PROGRAM.

Repeals the requirement to use the Hawaii ABLE Savings Program Trust Fund if the Director elects to accept deposits from contributors instead of sending deposits directly to the ABLE program manager. Authorizes the Director of Finance to expend moneys in the trust fund to provide incentive payments to Hawaii public school ABLE account owners. Appropriates funds for incentive payments to Hawaii public school ABLE account owners and to fund a position to provide statewide outreach, advocacy, and relationship management for the Hawaii ABLE Savings Program.

RELATING TO ENERGY.

Requires the Hawaii State Energy Office to conduct a study to identify the most cost-effective investments for clean energy alternatives to combustible fuels. Requires a report to the Legislature.

RELATING TO OVERDOSE PREVENTION.

Establishes and provides criteria for overdose prevention centers, including standards for the Department of Health to designate certain facilities as overdose prevention centers. Establishes an Overdose Prevention Center Oversight Committee. Provides immunity from state criminal prosecution for certain offenses for persons using a designated overdose prevention center and persons operating a designated overdose prevention center.

RELATING TO STATE LICENSED CARE FACILITIES.

Requires the Department of Health to post on its website an easily understandable, searchable, and sortable list of all state-licensed care facilities including information on their licenses and inspections. Requires that the list be updated within five days of any change in its information.

RELATING TO LOW-SPEED ELECTRIC BICYCLES.

Increases the minimum age to operate a low-speed electric bicycle from fifteen to sixteen years of age.

RELATING TO INCOME TAX.

Amends the income tax bracket for taxpayers filing a joint return and surviving spouses to exempt those taxpayers whose taxable income is $200,000 or less. Amends the income tax bracket for unmarried individuals and married individuals who do not file a joint tax return with their spouse to exempt those taxpayers whose taxable incomes is $100,000 or less.

RELATING TO TAXATION.

Requires tire retailers to collect and submit to the Department of Health certain information relating to tires sold by the retailer. Requires the Department of Health to establish and maintain a database containing this information.

RELATING TO ENVIRONMENTAL STEWARDSHIP FEES.

Effective 7/1/2027, establishes the Environmental Stewardship Fee Program within the Department of Land and Natural Resources, through which the Department will collect a fee from visitors for a license to visit a state park, forest, hiking trail, or other state natural area. Establishes the Environmental Stewardship Fee Special Fund effective 7/1/2025. Allocates a certain amount of transient accommodations tax revenues to the special fund. Requires report to the Legislature on strategic plan and timetable for objectives and implementation of the environmental stewardship fee program. Appropriates funds for the environmental stewardship fee strategic plan and positions for the Environmental Stewardship Fee Program.

RELATING TO ENVIRONMENTAL PROTECTION.

Allows the Department of Land and Natural Resources to contract or form a partnership with private parties to assist with the maintenance and management of sunscreen dispensers at all state beaches, as well as publicize that the mineral-based sunscreen in these dispensers is more protective of the coral reefs of the State. Appropriates funds for the installation, maintenance, management, and operation of non-chemical sunscreen dispensers on all state beaches.

RELATING TO AN AIRPORTS CORPORATION.

Establishes the Hawaii Airports Corporation (HAC)to assume the authority, functions, and duties of the Department of Transportation related to airports and aeronautics. Makes HAC subject to chapters 103D and 104, HRS. Provides for project labor agreements. Appropriates funds for the transfer of functions from DOT to HAC.

RELATING TO AGRICULTURAL TOURISM.

Requires the counties to adopt ordinances setting forth procedures and requirements for the review and permitting of agricultural tourism uses and activities as secondary uses, in addition to accessory uses, on a working farm or farming operation. Requires the counties' ordinances to include requirements that: the principal agricultural use on a working farm or farming operation preexists the issuance of any land use permit or building permit for any accessory and secondary use; agricultural tourism includes only those activities that are allowed under existing zoning and land use regulations; and agricultural tourism be allowed only on land on which productive agricultural use is occurring.

RELATING TO RENTAL HOUSING PROJECT DISASTER RECOVERY PERMITS.

Authorizes departments to issue permits for the development of multi-family rental housing projects on state or county land that was used for a multi-family rental housing project before a state emergency.

RELATED TO DRIVING UNDER THE INFLUENCE.

Requires defendants convicted of causing the death of a parent or legal guardian of a minor child by the operation of a vehicle in a negligent manner while under the influence of drugs or alcohol to make restitution in the form of financial support to each surviving child of the victim.

RELATING TO TRANSPORTATION FINANCING.

Authorizes a county that has adopted a surcharge to state tax to extend the surcharge to 12/31/2056. Extends the end date of the one percent Transient Accommodation Tax increase to 12/31/2056. Requires the State Auditor to conduct an audit and annual review of the Honolulu Authority for Rapid Transportation until 12/31/2056. Requires the Comptroller to certify the Honolulu Authority for Rapid Transportation's invoices for capital costs until 12/31/2056.

Authorizes the Director of Transportation to designate as a toll road, and impose toll charges for the use of, any existing state highway. Requires the Director of Transportation to designate as a toll road a certain portion of Hana Highway. Requires the Department of Transportation to develop a plan to exempt resident vehicle operators from the imposition of toll charges for the use of Hana Highway.

RELATING TO NATURAL RESOURCE MANAGEMENT.

Clarifies that the Board of Land and Natural Resources' authority shall supersede the Mauna Kea Stewardship and Oversight Authority for all lands designated under the state conservation district; provided that the Board of Land and Natural Resources upholds its affirmative and non-transferable duty to protect the traditional and customary rights of native Hawaiians as articulated in the Hawaii State Constitution. Clarifies that the natural resource management enforcement and emergency response over Mauna Kea lands shall remain the responsibility of the Division of Conservation and Resources Enforcement of the Department of Land and Natural Resources. Takes effect 7/1/2026.

RELATING TO TRANSPORTATION.

Requires the Department of Transportation to inspect personal aircraft that enter the State and land at state airports for the purpose of preventing the unauthorized transportation of fireworks and article pyrotechnic into the State. Requires the Department to coordinate with an appropriate law enforcement agency or county fire department to dispose of prohibited fireworks and articles pyrotechnic.

Requires the Attorney General to undertake enforcement activities. Appropriates moneys.

Defines "isolated wetlands" and "wetlands". Clarifies the definition of "state waters" to include wetlands and isolated wetlands. Requires the Director of Health to determine all wetlands in the State, including whether a wetland is an isolated wetland or is included in the waters of the United States. Prohibit persons from discharging any water pollutant into or at any location that enters state waters.

Establishes a criminal penalty and monetary fines for aquarium fishing violations. Clarifies that each fish or aquatic life specimen taken in violation of certain fishing laws regarding aquarium fish and the possession and use of prohibited explosives, electrofishing devices, and poisonous substances constitutes a separate offense.
