54-1731A. DRUG OUTLETS THAT DISPENSE PRESCRIPTION DRUGS — minimum requirements. All drug outlets shall: (1) Dispense prescription drugs only pursuant to a valid prescription drug order as set forth in this chapter; (2) Provide prospective drug review that shall include evaluation of a prescription drug order for known allergies, rational therapy contraindications, reasonable dose and route of administration, reasonable directions for use, duplication of therapy, drug interactions, and proper utilization; (3) Provide a complete and accurate label as set forth in this chapter; (4) Verify the accuracy of the drug stock selected relative to the drug prescribed. If not performed by a pharmacist, an electronic verification system or verification by two (2) support persons shall be necessary; and (5) Provide counseling for new medications. For refills or renewed prescriptions an offer to counsel the patient or caregiver shall be extended. Nothing in this section shall require a pharmacist to provide counseling when a patient or caregiver refuses such counseling, when counseling is otherwise impossible, or for inpatients of a hospital or institutional facility if a licensed health care professional administers the medication.
