54-1731B. DRUG OUTLETS WITH ALTERNATIVE DISPENSIng MODELS. (1) A drug outlet that dispenses prescription drugs to human patients that does not have a pharmacist or other prescriber on site to supervise pharmacy operations shall: (a) Maintain adequate video surveillance and retain a recording for a minimum of thirty (30) days. Provided, however, that self-service automated dispensing systems shall be excluded from the requirements of this paragraph; (b) Use an audio communication system to counsel and interact with each patient or patient’s caregiver; and (c) Remain closed to the public if either of the systems required pursuant to paragraphs (a) or (b) of this subsection are not functioning properly. (2) A drug outlet that stores drugs outside of a drug outlet for retrieval by a licensed health care professional shall comply with the following: (a) Drugs shall remain under the control of, and be routinely monitored and inventoried by, the supervising drug outlet; and (b) The storage area shall be appropriately equipped to ensure security and prevent diversion or tampering; (3) Stocking and replenishing of a drug outlet that stores drugs outside of a drug outlet for retrieval by a licensed health care professional may be performed by a pharmacist or prescriber or an appropriate support person if using an electronic verification system or a verification by two support persons.
