Sec. 40.2. "Community spouse", for purposes of IC 12-15-2, means an individual who: (1) is the spouse of an individual who resides in a nursing facility or another medical institution; and (2) does not reside in a nursing facility or another medical institution. As added by P.L.246-2005, SEC.98.
