"Transfer station"

Sec. 235. (a) "Transfer station", for purposes of: (1) IC 13-21; and (2) environmental management laws, except as provided in subsection (c); means a facility where solid waste is transferred from a vehicle or a container to another vehicle or container for transportation. (b) The term does not include a facility: (1) where the solid waste that is transferred has been generated by the facility or a recycling facility; or (2) where: (A) infectious waste (as defined in IC 16-41-16-4) is transferred directly between two (2) vehicles; (B) infectious waste is packaged in compliance with 410 IAC 1-3-24; and (C) packages of infectious waste are not opened at any time during the transfer. (c) "Transfer station", for purposes of IC 13-22-9, means a facility for the: (1) acceptance; (2) holding; and (3) loading; of solid waste into a vehicle for movement to a facility for processing, recycling, or disposal. The term does not include collection containers for solid waste.
