Sec. 285.5. "Unanticipated event or condition", for purposes of IC 14-34-4, means an event or condition that: (1) is encountered in a remining operation; and (2) was not contemplated by the applicable surface coal mining and reclamation permit. As added by P.L.179-1995, SEC.2.
