Sec. 7. (a) This section applies to criminal actions. (b) The clerk shall collect the marijuana eradication program fee set by the court under IC 15-16-7-8, if: (1) a weed control board has been established in the county under IC 15-16-7-3; and (2) the person has been convicted of an offense under IC 35-48-4 in a case prosecuted in that county.
