All appointments and promotions shall be made on the basis of seniority and a merit examination. \~\~ 3. \~\~ The allocation of duties described in this section shall not be interpreted to prevent flexibility in interdepartmental operations or to forbid other divisional allocations of duties in the discretion of the commissioner.
