Overpayment — limitations periods.

1. An administrative action to recover an overpayment to a provider shall be commenced within five years of the date the overpayment was incurred. For the purposes of this subsection , “incurred” means the date the medical assistance claim was paid, or the date any applicable reconciliation was completed, whichever is later. 2. An administrative action to impose a sanction related to an overpayment to a provider shall be commenced within five years of the date the conduct underlying the sanction concluded, or the director discovered such conduct, whichever is later. 2013 Acts, ch 24, §6
