17-1705. Same; contracts and actions concerning real estate. Such subordinate organizations may contract, sue and be sued through its trustees or managers, in any matter affecting such real estate or buildings: Provided, That no judgment rendered against such organization shall have any force or effect except as against the property owned as provided herein. Summunduwot Lodge, 143 Kan. 502, 505, 506, 54 P.2d 985. 2. Trustees of benevolent society may maintain action to foreclose mortgage, when. Malone v. Wimmer, 147 Kan. 177, 178, 180, 75 P.2d 224. 3. A church corporation has no immunity as to liability in tort and is liable for wrongful death resulting from fall on church property. McAtee v. St. Paul's Mission, 190 Kan. 518, 376 P.2d 823.
