State failed to put on evidence to show victim was eighteen years of age; conviction under K.S.A. 21-3412a reversed. State v. Perez-Rivera, 41 Kan. App. 2d 579, 203 P.3d 735 (2009). 2. Domestic battery statute constitutional; no conflict with Kansas' defense of marriage amendment to Kansas constitution. State v. Curreri, 42 Kan. App. 2d 460, 213 P.3d 1084 (2009). 3. Misdemeanor battery is a lesser included offense of domestic battery. State v. Harris, 46 Kan. App. 2d 848, 264 P.3d 1055 (2011).
