Whether the state is statutorily precluded from challenging defendant's criminal history worksheet examined. State v. Hankins, 19 Kan. App. 2d 1036, 1046, 880 P.2d 271 (1994). 2. Prosecutor has authority to recommend upward departure sentence to facilitate plea agreement. Soto v. State, 23 Kan. App. 2d 85, 89, 927 P.2d 954 (1996). 3. Plea bargain does not create contract between defendant and state; specific performance inapplicable. State v. Ford, 23 Kan. App. 2d 248, 253, 930 P.2d 1089 (1996). 4. Severity level of drug possession charge under K.S.A. 65-4162 should have been enhanced for conviction under prior statute (K.S.A. 65-4127b). State v. Crank, 262 Kan. 449, 456, 989 P.2d 890 (1997). 5. Alleged prosecutorial manipulation of criminal history scores by discretionary use of prior convictions not sufficient to raise equal protection claim. State v. Taylor, 262 Kan. 471, 476, 939 P.2d 904 (1997). 6. Trial court setting aside plea agreement where prosecutor excluded certain convictions in calculating criminal history upheld. State v. Unruh, 263 Kan. 185, 188, 946 P.2d 1369 (1997). 7. Sentence vacated; prosecutor cannot enter into plea agreement wherein government agrees to exclude any prior convictions from criminal history of defendant. State v. Hernandez, 29 Kan. App. 2d 522, 28 P.3d 1031 (2001). 8. Under facts of case, state may not rescind plea agreement. State v. Boley, 279 Kan. 989, 113 P.3d 248 (2005). 9. Court may impose a sentence independent of any agreement of the parties. State v. Chetwood, 38 Kan. App. 2d 620, 625 (2007). 10. Plea agreements and sentencing recommendations do not bind the sentencing court. Harms v. Cline, 27 F. Supp. 3d 1173, 1180 (2014).
