22-2903. Exclusion and separation of witnesses. During the examination of any witnesses or when the defendant is making a statement or testifying the magistrate may, and on the request of the defendant or state shall, exclude all other witnesses. He may also cause the witnesses to be kept separate and to be prevented from communicating with each other until all are examined. History: L. 1970, ch. 129, § 22-2903; July 1. Mandatory provisions of section apply to appearances before magistrate up to and including preliminary examination, not to trial. State v. Ralls, 213 Kan. 249, 252, 253, 515 P.2d 1205. 2. Mandatory features apply only to preliminary phases of prosecution leading up to and including preliminary examination. State v. McVeigh, 213 Kan. 432, 436, 516 P.2d 918. 3.
