23-3315. Best interest of a child. (a) When determining whether an order of visitation to a nonparent is in the best interest of a child, the court shall consider: (1) The nature and extent of the relationship between the child and the parent or person acting as a parent; (2) the nature and extent of the relationship between the child and the nonparent; (3) past or present conduct by a party or individual living with a party that poses a risk to the physical, emotional or psychological well-being of the child; (4) the likely impact of the requested order on the relationship between the child and the parent or person acting as a parent; (5) the applicable factors in K.S.A. 23-3203, and amendments thereto; and (6) any other factor affecting the best interest of the child. (b) The court may consider the views of the child, taking into account the age and maturity of the child. History: L. 2024, ch. 52, § 11; July 1.
