36-515. Violation of standards; denial, suspension, revocation or refusal to renew or modify license; violation of act declared to be misdemeanor; injunctive relief. (a) After notice and opportunity for a hearing in accordance with the provisions of the Kansas administrative procedure act, the secretary may deny, suspend, revoke, refuse to renew or modify the license to operate a lodging establishment if the licensee failed to comply with the standards, provisions or requirements established pursuant to the lodging inspection act, or any rule or regulation adopted thereunder. (b) The secretary may seek injunctive relief from the district court to enjoin any operator of a lodging establishment from conducting business when such operator has: (1) Failed to make application for or to obtain a license for such purpose as required by the lodging inspection act; (2) had such license suspended, denied or revoked; or (3) failed to comply with the standards established pursuant to the lodging inspection act, or rules and regulations adopted thereunder.
