38-2292. Risk and needs assessment for children exhibiting juvenile offender behavior. (a) On or before October 1, 2023, the secretary for children and families shall identify an evidence-based risk and needs assessment to administer to children who have been identified as exhibiting behavior that could lead to juvenile offender charges related to physical violence, aggression, damage to property or use of life-threatening drugs during the course of a child in need of care proceeding. (b) The secretary for children and families shall administer the assessment described in subsection (a) and shall collaborate with the secretary of corrections to allow children identified pursuant to subsection (a) to participate in evidence-based community programs offered pursuant to K.S.A. 75-52,164, and amendments thereto. (c) The results of an assessment administered pursuant to this section shall be considered a part of the official file described in K.S.A. 38-2209, and amendments thereto, and shall not be admitted into evidence during the course of a proceeding under the revised Kansas juvenile justice code. (d) On or before January 1, 2024, the secretary for children and families shall report on the implementation of this section and provide the assessment identified in subsection (a) to the joint committee on corrections and juvenile justice oversight.
