44-1823. Elevator operation jeopardizing public safety; determination by state fire marshal; notification that operation unlawful; affixation of label to elevator; criminal penalty for unauthorized operation or removal of label. (a) The state fire marshal shall adopt a suitable label to be prominently affixed to the doors of any elevator if the state fire marshal determines that continued operation of such elevator would jeopardize public safety. Such label shall provide notice that the elevator is not certified for operation and that it is unlawful for any unauthorized person to operate such elevator or remove such label. (b) Any unauthorized person who operates an elevator that has a label affixed to such elevator as provided by subsection (a) or removes such a label from an elevator shall be guilty of a class A nonperson misdemeanor.
