48-3035. (KCMJ Art. 112) Drunkeness and other incapacitation offenses. (a) Any person subject to this code shall be punished at the direction of a commanding officer if such person is found drunk on duty. (b) Any person subject to this code shall be punished at the direction of a commanding officer if such person, as a result of indulgence in any alcoholic beverage or any drug, is incapacitated for the proper performance of duty.
