48-3058. (KCMJ Art. 115) Communicating threats. (a) Any person subject to this code shall be punished at the direction of a commanding officer if such person communicates a threat to injure the person, property or reputation of another. (b) Any person subject to this code shall be punished at the direction of a commanding officer if such person communicates a threat to injure the person or property of another by use of: (1) An explosive; (2) a weapon of mass destruction; (3) a biological or chemical agent, substance or weapon; or (4) a hazardous material. (c) Any person subject to this code shall be punished at the direction of a commanding officer if such person maliciously communicates a false threat concerning the person or property of another by use of: (1) An explosive; (2) a weapon of mass destruction; (3) a biological or chemical agent, substance or weapon; or (4) a hazardous material. (d) As used in this section, "false threat" means a threat that, at the time it is communicated, is known to be untrue by the person communicating the threat. History: L. 2024, ch. 78, § 19; July 1.
