59-2945. Name and citation of act. The provisions of K.S.A. 59-2945 through 59-2986 and amendments thereto shall be known and may be cited as the care and treatment act for mentally ill persons. History: L. 1996, ch. 167, § 1; April 18. Attorney General's Opinions: Determination of "qualified mental health professionals." 2000-36. Application of HIPAA to testimony given at care and treatment proceedings. 2004-21. Minor, 14 or older, may consent to medical treatment as a voluntary patient but treating facility must notify minor's parent or guardian; opinion 2003-25 is withdrawn so far as it conflicts. 2004-22. Cited in opinion detailing allowable costs and persons or entities responsible for payments relating to mentally ill persons. 2008-7. CASE ANNOTATIONS 1. Outpatient mental health center owed no duty to those injured by patient. Adams v. Board of Sedgwick County Comm'rs, 289 Kan. 577, 214 P.3d 1173 (2009). 2. Secretary of SRS cannot legally comply with order pursuant to K.S.A. 22-3303(1) and K.S.A. 59-2945 et seq. if incompetency is due to traumatic brain injury. State v. Johnson, 289 Kan. 870, 218 P.3d 46 (2009). 3. Kansas Sexual Violent Predator Act did not violate equal protection by treating sexual predators differently from people civilly committed for mental illness. Merryfield v. State, 44 Kan. App. 2d 817, 241 P.3d 573 (2010).
