Severity level of drug possession charge under K.S.A. 65-4162 should have been enhanced for conviction under prior statute (K.S.A. 65-4127b). State v. Crank, 262 Kan. 449, 452, 989 P.2d 890 (1997). 2. Departure sentence for nonbase conspiracy conviction exceeding double the presumptive sentence in violation of K.S.A. 21-4719(b)(2) reversed. State v. Hernandez, 24 Kan. App. 2d 285, 290, 944 P.2d 188 (1997). 3. Trial court ruling that prohibited defendants from asserting free exercise argument in marijuana cultivation case upheld.
