65-539. Local code requirements for child care centers; space required for such centers; administration by director of early childhood on and after July 1, 2026. (a) A licensed child care center shall meet the legal requirements of the local jurisdiction where the child care center is located for fire protection, water supply and sewage disposal. (b) (1) The designated area for children's activities shall contain a minimum of 28 square feet of floor space per child, excluding kitchens, passageways, storage areas and bathrooms. (2) There shall be a minimum of 60 square feet of outdoor play space on the premises for each child using the space at any given time. (c) On and after July 1, 2026, this section shall be administered by the director of early childhood. (d) From July 1, 2025, to June 30, 2026, this section shall be a part of and supplemental to article 5 of chapter 65 of the Kansas Statutes Annotated, and amendments thereto.
