The state established unconstitutional, wealth-based disparities by withholding all capital outlay state aid payments to which certain school districts were otherwise entitled. Gannon v. State, 298 Kan. 1107, 319 P.3d 1196 (2014). 2. Legislature failed to cure wealth-based disparities in calculating and distributing capital outlay state aid that were identified in Gannon I. Gannon v. State, 303 Kan. 682, 712-20, 368 P.3d 1024 (2016).
