75-5070. Noise studies; when; funding of abatement measures; rules and regulations. (a) On and after the effective date of this act, the secretary of the department of transportation shall conduct and analyze noise studies when the secretary participates in highway reconstruction projects which add through traffic lanes. (b) State highway funds may be used for noise abatement measures when it is determined by the secretary that the overall noise abatement benefits outweigh the overall adverse social, economic and environmental effects and the costs of the noise abatement measures. (c) The secretary of the department of transportation may adopt rules and regulations necessary for the implementation of the provisions of this section. History: L. 1999, ch. 137, § 41; July 1.
