79-1301. Dogs as personalty; rights and restraints. A dog shall be considered as personal property and have all the rights and privileges and be subject to like lawful restraints as other livestock. Fisher, 142 Kan. 627, 628, 629, 50 P.2d 983. 2. Dog not listed for taxation is personal property and subject to larceny. State v. Fenske, 144 Kan. 560, 561, 61 P.2d 1368. 3. It is unlawful to seize a dog absent a warrant or circumstances justifying an exception to the warrant requirement. Mayfield v. Bethards, 826 F.3d 1252, 1256 (10th Cir. 2016).
