84-2-307. Delivery in single lot or several lots. Unless otherwise agreed all goods called for by a contract for sale must be tendered in a single delivery and payment is due only on such tender but where the circumstances give either party the right to make or demand delivery in lots the price if it can be apportioned may be demanded for each lot. History: L. 1965, ch. 564, § 41; January 1, 1966. KANSAS COMMENT, 1996 1. This section, together with the two following sections, fills in the terms of delivery when the parties have left them open. In many, perhaps most, commercial sales contracts, the parties will specify terms of delivery and these sections will have limited application. See also 84-2-319 et seq. (addressing various mercantile terms). 2. This section continues the presumption of existing law that, unless agreed otherwise, the parties intend delivery to be in a single lot with payment due at that time. When the contract authorizes or requires delivery of the goods in separate lots to be accepted separately, the contract is an "installment contract" and section 84-2-612 applies.
