84-2a-205. Firm offers. An offer by a merchant to lease goods to or from another person in a signed writing that by its terms gives assurance it will be held open is not revocable, for lack of consideration, during the time stated or, if no time is stated, for a reasonable time, but in no event may the period of irrevocability exceed three months. Any such term of assurance on a form supplied by the offeree must be separately signed by the offeror. History: L. 1991, ch. 295, § 14; February 1, 1992. KANSAS COMMENT, 1996 This section provides a way, in addition to the ways available at common law, for merchant lessors or lessees to make an offer irrevocable. The source of the section is 84-2-205, with changes only to make the provision applicable to leases. See 1996 Kansas Comments to 84-2-205 for further discussion.
