K.S.A. 84-2a-532

84-2a-532. Lessor's rights to residual interest. In addition to any other recovery permitted by this article or other law, the lessor may recover from the lessee an amount that will fully compensate the lessor for any loss of or damage to the lessor's residual interest in the goods caused by the default of the lessee. History: L. 1991, ch. 295, § 80; February 1, 1992. KANSAS COMMENT, 1996 The lessor, unlike a seller in a sales transaction, retains ownership of the goods and the goods will be returned to it when the term of the lease expires. See 84-2a-103(1)(q) (defining lessor's residual interest). This residual interest in the goods may be injured if the lessee defaults on the lease by, for example, failing to return the goods or returning the goods damaged at the end of the lease. This section was added to the 1990 official text to permit the lessor to recover damages for any injury to its residual interest, in addition to any other recovery to which it is entitled under this Article.
