Limitation on designation of cabinet or Department for Medicaid Services as qualified health entity

Services as qualified health entity. Unless expressly required under federal law, neither the cabinet nor the Department for Medicaid Services shall be designated as a qualified health entity for the purpose of making presumptive eligibility determinations for the state's medical assistance program.
