The proposed amendment to Regulation 36 would add § 103.2.a.iv to reflect the PERS practice of using the minimum wage standard as the minimum compensation for non-elected positions when there is an eligibility question regarding a member’s actual hours worked. The effective date of the amendment will be August 1, 2022.

The Temporary Variable Compensation Plan for FY 2022 establishes compensation policies for state employees under the purview of the MSPB for FY 2022. The Plan is to be effective January 1, 2022, based upon Legislative requirements of implementation of the Plan.

The amendments would add Section 1.28 Self Directed Brokerage Account to provide a definition for “Self Directed Brokerage Account,” amend Section 6.1 Investment Options and Group Trusts to allow the Self Directed Brokerage Account, amend Section 7.10 Location of Participant or Beneficiary Unknown to modify the way uncashed checks are handled within the plan, and amend Section 9.2 Rollovers from this Plan to allow rollovers to Simple IRAs.

The proposed amendments to Regulation 45A would reference a new form for disability retirees who are reemployed by a covered employer to reduce confusion among employers.
