This rule was amended to include an exemption from HB 549 from the 2023 Regular Session. Generally, the bill exempts the gross proceeds of sales of tangible personal property by a manufacturer when shipped out of state and first use occurs out of state along with providing activities that do not establish a first use. This is addressed in new paragraph 502. Old paragraph 502 was moved to new paragraph 501. Paragraph 602 was reworded to better reflect how sales and use tax is currently reported. Section 41-59-5 (3), Mississippi Code of 1972, as amended, establishes the Mississippi State Department of Health is the lead agency shall establish and maintain a program for the improvement and regulation of emergency medical services. The Board is authorized to promulgate and enforce such rules, regulations and minimum standards as needed to carry out these provisions. The proposed changes reflect the National Scope of Practice for EMS providers

This is a proposed amendment to an existing rule which will require dispensing physicians of a permitted facility to comply will the same compounding requirements of permitted pharmacies. The Mississippi State Board of Medical Licensure was notified of the amendment and supports the change

This is a proposed amendment to an existing rule which will allow a single pharmacist to transfer a prescription from one pharmacy to another if the pharmacies share a common computerized system when done at the request of the patient. The transfer is limited to one time. Currently, the rules do not allow a single pharmacist to make a transfer, rather the rules require a transfer to be done pharmacist to pharmacist
