Due to the effects of Hurricane Ida, The Department issues this temporary rule to provide a waiver for ASTM Reid Vapor Pressure Specifications related to gasoline and gasoline blended with one or more percent ethanol. The reasoning for this waiver is that the EPA has reissued a waiver of the RVP for Mississippi and other states affected by Hurricane Ida for the time period September 1, 2021 – September 15, 2021. This should provide a greater supply of gasoline for sale in the state.

This Administrative Code is being filed to require providers to provide a thirty (30) day written notice to beneficiaries and the Division of Medicaid prior to the discontinuation of services. If a provider fails to provide the notice, the provider will not be reimbursed for the thirty (30) day period the beneficiary and Division of Medicaid should have been notified. This rule will not apply if the failure to provide notice was due to circumstances outside of the provider’s control.

This rule will not apply if the failure to provide notice was due to circumstances outside of the provider’s control. This is an emergency filing due to the risk to public health due to a sudden stoppage of services to beneficiaries that require high levels of care.

Rule 76.10 is proposed for repeal, as it a restatement of current governing statute and does not promulgate any administrative rules beyond the statute.
