This Administrative Code is being filed to (1) add language allowing FQHCs and RHCs to act as a originating and distant site and (2) and for FQHCs, RHCs, and CMHCs to receive both the distant site and originating site fees when such services are appropriately provided by the same organization, in compliance with Miss. To establish deadlines related to the suspension of strict compliance with specific state statutes, State Board of Education policies, manuals, and process standards for the 2020 – 2021 school year following Governor Tate Reeves’ Proclamation of a State of Emergency as a result of the impact of COVID-19 (coronavirus) on school districts in accordance with Miss. Code Ann. §§ 33-15-31, 33-15-11(b)(9) and 33-15-11(c)(1). The SBE granted a temporary suspension of the deadline set in Process Standard 4 to extend the deadline by six (6) months to reflect OMB's extension (September 30, 2021) for the Fiscal Year 2020 audits. Additionally, the deadline set in Process Standard 31 has been extended to December 31, 2021 for the submission of the annual 40 hours of training for Fiscal Year 2022 MCOPS grant recipients and SROs as a result of the ongoing impact of COVID-19 on training opportunities still applies. Beginning with the 2021 – 2022 school year, districts shall comply with all applicable state and federal regulations, State Board Policies and performance and process standards set forth in the current edition of the Mississippi Public School Accountability Standards.

The Honorable Governor of Mississippi, Tate Reeves, issued a Proclamation on March 14, 2020, declaring that a State of Emergency exists in the State of Mississippi as a result o f the outbreak of COVID-19. Pursuant to the December 11th, 2020, Meeting of the Mississippi Board of Nursing Board of Directors, the Board voted to continue conducting informal and formal disciplinary proceedings virtually during the COVID-19 pandemic. The Board adopts the temporary rule herein in an effort to ensure public safety and prevent the spread of COVID-19.

This rule was amended for Miss. Code Ann. Section 57-89-3(a) that includes certain approved entities as production partners for a film project wanting to claim non-resident payroll as part of base investment. The rule was amended for SB 2971 passed in the 2021 Regular Session that grants the option of having a movie rebate submission audited by a qualified CPA. The rule was also amended to update current practices of the Department of Revenue in auditing movie rebate submissions. Other minor changes were made throughout.

Paragraph 104.02 was amended to remove the agency structure. New paragraph 109 was added per Senate Bill 2971 of the 2021 Regular Session to provide the email address where qualified accountants must send a third-party audit. Other minor changes were made throughout.

Policies in this document provide a clear description of temporary operations needed during the COVID-19 pandemic. These additional policies are temporary and do not amend or replace any policy within the Child Care Payment Program Policy Manual.
