This is an amendment to streamline the regulation addressing pharmacy benefit managers.

This is an amendment to remove the requirement that a pharmacy technician become certified prior to renewal. Allows alternate training for pharmacy technicians.

This Administrative Code is being filed to correspond with MS SPA 20-0002 that added coverage and reimbursement of PDN and PCS for Early and Periodic Screening, Diagnosis and Treatment (EPSDT)-eligible beneficiaries. The final filing removes the five percent (5%) reduction language and makes technical corrections.

This Administrative Code filing removes the prior authorization requirement for nebulizers and inhaler spacers. The Division of Medicaid (DOM) will cover four (4) spacers a year without prior authorization, and will no longer require prior authorization on nebulizers based on data from September 2019 to present showing 727 prior authorization requests approved and only 2 requests denied for technical errors.

Mississippi Constitution Initiative Measure No. 65 was overturned by the Mississippi Supreme Court with the ruling issued on May 14, 2021.

These rules are required by MS Constitution Initiative Measure No. 65 to ensure the availability of and safe access to medical marijuana for qualified persons with debilitating medical conditions.

Due to the delay of gasoline deliveries through the interstate pipeline systems caused by Winter Storm Uri, The Department issues this temporary rule to provide a waiver for ASTM Reid Vapor Pressure Specifications related to gasoline and gasoline blended with one or more percent ethanol. The reasoning for this waiver is to avoid supply disruptions for Mississippi and other states affected by the Winter Storm for the time period April 1, 2021 through April 30, 2021. This should provide a greater supply of gasoline for sale in the state.

The State Board of Health shall have the authority, in its discretion, to establish programs to promote the public health, to be administered by the State Department of Health. The State Board of Health approved the first STEMI System of Care Plan in 2011. The Board approved STEMI System Rules and Regulations in 2017. This proposed change to said rules adds a rule to address meeting attendance for STEMI Advisory Committee members.
